The Anti-Counterfeit Act, no. 13 of 2008.

This Act, divided into six Parts and consisting of 37 articles, prohibits trade in counterfeit goods, establishes the Anti-Counterfeit Authority, and provides measures for the protection of intellectual property rights. The Act defines the following relevant terms: consumer protection; actions of counterfeiting, including: packaging, labelling, or producing protected goods without the authority of the owner of intellectual property right, deliberate and fraudulent mislabelling of medicinal products; counterfeit marks; importer and exporter of goods; intellectual property rights, including plant breeders' rights; protected goods. The Act concerns: establishment, power and functions of the Authority and of its Board, including: informing the public on matters relating to counterfeiting, advising the government on policies and measures concerning the necessary support, promotion and protection of intellectual property rights; liability and compensation of the Board for damage or loss suffered by any person on application of the provisions of the Act; financial provisions and fund of the Authority; appointment of inspectors and specification of their powers; detailed offences concerning counterfeit goods; application related to trademarks; penalties.
