Abstract
The Act aims to secure the safety of health functional foods, their quality and to promote their sound distribution and sale.
The Act sets out procedures for obtaining licences from the Commissioner of the Korea Food and Drug Administration to manufacture health functional foods. Any person who intends to import this food shall file a declaration of importing health functional foods with the Commissioner.
The Commissioner of the Korea Food and Drug Administration shall determine and notify: standards and specifications for manufacturing, using and preserving health functional foods for sale; raw materials or ingredients which can be used for health functional foods; and standards of labeling and packaging.
The Act further provides for: inspection measures; good manufacturing practice regulations; health functional foods which must not be sold, manufactured, imported, used, stores transported or displayed for sale; the establishment of the Health Functional Foods Deliberation Committee; administrative sanctions, corrective orders and revocation of licences; penalties; etc.
