Ministerial Decree No. 102 validating the Regulation on tenders for the allotment of fishing areas.

This Ministerial Decree establishes the modalities of concession of fishing rights and the allotment of fishing areas (fishing waterbodies) to natural and legal persons. It shall not be applicable to protected areas. Tenders for the allotment of fishing waterbodies shall be carried out by the Commission set up by the Government. The establishment of fishing waterbodies (fishing areas) and boundaries thereof shall be determined by the authorized fishing institution on the basis of the recommendations of scientific institutions. The participants in tender must comply with the following requirements: (a) to carry out fisheries; (b) to have fishing vessels and fishing gear; (c) to have processing and storage facilities for fish products; (d) to have fisheries development project; (e) to have fishing inspectors; (f) not to have tax arrears; and (g) to concede servitude to the authorized fisheries institution and scientific research organizations for non-commercial, sport and artisanal fishing.
