Abstract
This Act provides for regulation of poisons, opium and dangerous drugs. It consists of seven chapters: I. Preliminary; II. Poisons; III. Poppy, Coca and Indian Hemp Plants; IV. Raw and Prepared Opium; V. Dangerous Drugs; VI. Transit and Transhipment of Opium and Dangerous Drugs and Plants; and VII. Supplementary.
Chapter I provides for the short title and definitions. Chapter II imposes restrictions on the sale of poisons. It allows pharmacists, medical practitioners, veterinary surgeons and certain wholesale druggists to dispense and sell poisons in course of their profession or business. The Ordinance provides for sale of specially prepared poisons, by licensed persons, to be used in agriculture or horticulture; for the destruction of insects, fungi, bacteria or weeds; or for the veterinary treatment of animals. It restricts any person from selling any poison included in Part III of the First Schedule, except on and in accordance with a prescription given by a medical practitioner or veterinary surgeon. It also contains provisions relating to prescriptions, record keeping, labelling and storing of poisons.
Chapter III prohibits planting and cultivation, import or export of poppy plant, coca plant or hemp plant, or any part thereof. Chapter IV restricts import, possession, supply and distribution of opium except as provided by the Ordinance. Chapter V imposes restrictions on the import, export, manufacture, sale and possession of dangerous drugs. It allows the Director of Health Services to supply dangerous drugs to a medical practitioner, veterinary surgeon, pharmacists, estate hospitals and dispensaries. The conditions for supply of dangerous drugs, prescription and labelling requirements are laid down. Chapter VI makes it unlawful to carry through Sri Lanka or its territorial waters, opium, poppy, coca or hemp plants or any dangerous drugs, except as provided. Chapter VII contains provisions in respect of customs, inspections, offences and penalties.
