Abstract
Article 1 of this Law, comprising 25 articles, stipulates that contractors are required to register with the designated Public Authority for Water register before commencing water well drilling, as directed by the Board of Directors, which will define registration criteria and preservation procedures. Furthermore, Article 2 outlines current requirements, such as residency, full legal capacity, registration in the commercial registry, possession of a municipal license, appointment of a qualified geologist or engineer for drilling projects, and ownership of suitable machinery and equipment. Contractors involved in water well drilling are categorized based on financial capacity and technical expertise into three tiers: (1) First-class contractors require a minimum capital of 100,000 dinars, five years of drilling experience, a permanent technical team with geologists and engineers, technicians with five years of experience, three drilling machines with spare parts worth 25% of their value, and three pumps with generators; (2) Second-class contractors need a capital of at least 50,000 dinars, four years of drilling experience, a similar technical team, technicians with three years of experience, two drilling machines with spare parts, and two pumps with generators; (3) Third-class contractors must have a capital of at least 25,000 dinars, two years of drilling experience, support from qualified geologists, technicians with three years of experience, one drilling machine with spare parts, and one pump with a generator. Contractors who do not meet one or more of the conditions for registration in one of the advanced categories shall be registered as probationary contractors. Article 12 provides for forming a Committee for registering water well drilling contractors with the main task of issuing a decision on every application referred to it within thirty days from the date of its submission. Under Article 18 contractors must provide the Public Authority for Water, within one month of completing the drilling work, with a technical report detailing the drilling process, including a geological description of the well, results of pumping tests, water quality, aquifer thickness, well construction, chemical analysis, well productivity, static water level, and dynamic water level.
