Abstract
This Law consisting of 12 articles aims at (i) establishing the Ministry of Dams and Water Resources and organizing its competencies; (ii) replacing some articles of Law No. 112 of 1973; (iii) repealing Law No. 26 of 1972.
Article 1 establishes the Ministry, to oversee the formulation and execution of policies, planning, monitoring, and supervision of dam construction, water resource utilization, and conservation in the country, particularly focusing on agricultural, industrial, and economic developments, with responsibilities including conducting studies and research on dams and reservoirs, coordinating water consumption among various sectors, proposing legislation for water use, conducting scientific and applied water research nationwide, executing dam projects, overseeing water extraction projects, and ensuring compliance with issued directives. The General Administration of Planning, Follow-up, and Statistics Department, as per Article 3, is tasked with conducting technical studies to execute the overarching dam construction and water source utilization policy, gathering and analyzing data, formulating plans, overseeing their execution to define objectives, programs, and priorities, fostering technical cooperation with diverse nations, providing recommendations for sector coordination, public education on water consumption, and devising training programs for dam and water resource personnel. Other main Departments are (i) the General Administration of Dams and Valley Water; (ii) the General Administration of Groundwater; and (iii) the General Administration of Financial and Administrative Affairs. Article 8 provides for the transfer to the Ministry of the powers previously handled by the Public Water Authority and its rights, obligations, and appropriations.
The amendments to Law No. 112 of 1973 replace articles 12, 16, and 24, (i) establishing committees for registering water well drilling contractors and addressing appeals, chaired by the Minister of Dams and Water Resources; (ii) empowering the Minister to issue necessary decisions for law enforcement; (iii) substituting the term "Public Water Authority" with "Ministry of Dams and Water Resources" throughout the law and other legislation.
