Decree No. 381 of the Ministry of Ecology and Natural Resources validating the Regulation on evaluation of damage to subsoil.

This Ministerial Decree establishes the modalities of evaluation of environmental damage, resulting from the infringement of the legislation on subsoil and compensation therefore. The damages shall be classified as direct (quantitative and qualitative reduction of minerals) and indirect (manifesting after specified period of time). Compensation of damages shall not exonerate the culprit from carrying out the arrangements for the mitigation of consequences of environmental pollution. This Ministerial Decree also establishes calculation formula for damages caused to subsoil by illegal mining and extraction of minerals.
