Abstract
This Government Decision establishes the technical and safety conditions for placing aerosol dispensers on the market. The Act defines aerosol dispenser and specifies its material composition and functional characteristics. It excludes dispensers with a total capacity below 50 ml and those exceeding certain maximum capacities set in the annex. The Decision introduces the mandatory reversed epsilon (ε) marking to attest conformity with its provisions and links its labelling regime to the national Regulation on classification, labelling and packaging of substances and mixtures. The Decision sets detailed labelling obligations: each aerosol dispenser must indicate the name and address or trademark of the person responsible for placing it on the market, the ε symbol, coded batch markings, specific details listed in the annex, and the net content by volume. Where the dispenser contains flammable components but is not classified as flammable or extremely flammable, the percentage by mass of flammable components must be clearly stated on the label. All mandatory information must be in Romanian, without excluding additional languages, and markings that could be confused with the ε symbol are prohibited. The annex provides extensive technical definitions (e.g. net capacity, total capacity, chemical heat of combustion, flammable components) and classification criteria for non-flammable, flammable and extremely flammable aerosols, including separate rules for sprayed and foaming aerosols. The annex further lays down construction, equipment, filling, pressure, and testing requirements for metal, glass (protected and unprotected) and plastic containers, including maximum capacities, test pressures, permissible internal pressures at specified temperatures, and limits on the liquid phase volume at 50 °C. It prescribes hydraulic pressure tests, burst tests, drop tests for protected glass, and final testing of filled aerosols by hot-water bath or approved alternative hot or cold methods, with detailed sampling plans and rejection criteria for lots. It also regulates flammability testing through standardized procedures for ignition distance, ignition in enclosed space, and foam flammability, including test apparatus, environmental conditions, step-by-step procedures, and methods for evaluating and recording results. The Environmental Protection Inspectorate is designated as the competent market surveillance authority for labelling, marking, declarations of conformity and technical documentation, empowered to order temporary prohibitions and corrective measures where products, though formally compliant, present safety or health risks, and to cooperate with other authorities and accredited conformity assessment bodies.
