Abstract
This Government Decision approves the Regulation on the content and format of records of plant protection products (phytosanitary products) kept by professional users. The Act defines the obligation of professional users of plant protection products to keep specific records and aligns Moldovan practice with European Union requirements, in the context of Moldova’s EU integration process. The Regulation requires professional users to include in their records the information listed in Annex 1, differentiated by type of use: treatment of surfaces (e.g. agricultural land, recreational areas, railways, greenhouses), treatment of enclosed spaces (e.g. storage facilities, permanent greenhouses) and treatment of seeds or plant reproductive material. For each use, users must record the commercial name and authorization number of the product, date and time of application, dose and units of application, method of identifying the treated area or installation, size or volume treated, and crop names, land-use situations and growth stages according to OEPP codes and the BBCH monograph. Annex 2 sets out a standard “Register of records of the use of phytosanitary products” to be used, on a transitional basis, by professional users until the creation of the Integrated Administration and Control System. The Regulation establishes that records must be kept in an electronically processable format enabling software to identify, recognize and extract data, in line with open data and public sector information reuse rules. Professional users must register each use within five working days and, where records are initially kept in another format, transfer them into the required electronic format within 30 days, with longer transfer periods allowed for uses before 1 January 2030, subject to a final deadline of 31 January of the year following use. The competent policy-implementing authority may request the information contained in the records, which must be supplied within five working days, or within ten working days in certain cases where early provision in electronic format is explicitly requested. Professional users acting under contractual arrangements must give the contracting person access to, or copies of, the records without unjustified delay. The Decision assigns control over implementation to the National Food Safety Agency and sets a 12 month deadline for integrating OEPP and BBCH codes and pest and crop names into the relevant state registers and information systems.
