Abstract
This Law establishes the basic regulatory framework and state policy in the field of activity with phytosanitary products, the norms for authorization and introduction on the market of phytosanitary products presented in commercial form, regulates the conditions for their authorization, manufacturing, transportation, storage, marketing and use harmless to human health, animal health and the environment, the reports related to state supervision and control over compliance with the legislation in the field, also determines the rights and obligations of natural and legal persons, the powers of the competent authorities in the field. The scope of this Law is to ensure a high level of protection of human health, animal health and the environment, as well as to increase the efficiency of the functioning of the internal market by harmonizing the rules for placing phytosanitary products on the market, while improving agricultural production. Basic principles of state policy in the field of activity with phytosanitary products are as follows: (a) precautions to ensure that active substances and products placed on the market do not have a negative effect on human health, animal health or the environment; (b) scientific substantiation of decisions on the authorization and placing on the market of phytosanitary products; (c) increasing the efficiency of the functioning of the internal market by harmonizing the rules for placing phytosanitary products on the market, while improving agricultural production; (d) the harmlessness of phytosanitary products for human health, animal health and the environment in the case of their manufacturing, approval, authorization and application, provided that the requirements established by phytosanitary norms and other normative acts are complied with; and (e) promoting a unitary state policy in the field. This Law applies to plant protection products containing or consisting of active substances, safeners or synergists, in the form in which they are presented to the user. This Law applies to substances, including microorganisms, which have a general or specific action on harmful organisms, on plants or parts thereof or on plant products. Active substances, basic substances, candidates for substitution, safeners, synergists and co-formulants, approved by the European Union, are unconditionally recognized for the period of their approval by the order issued by the competent policy-making authority. The list of active substances is adjusted quarterly or at the proposal of the competent authority issuing the authorization, in accordance with European Union regulations. A phytosanitary product may not be placed on the market or used without having been authorized in accordance with this Law. The competent authority for policy implementation shall not prohibit the placing on the market and use of seeds treated with plant protection products authorized for this purpose in one of the Member States of the European Union. The labelling of plant protection products includes the classification, labelling, packaging requirements and the standard phrases regarding risks and precautionary measures. Producers, suppliers, distributors, importers and exporters of phytosanitary products shall keep, for a period of at least 5 years, records of the phytosanitary products they produce, import, export, store or place on the market. Law No. № LP277/2018 “On chemical substances” shall be amended to add the following wording: “Plant protection products together with active substances, approved until the entry into force of this Law, are recognized for the period until the expiration of the authorization for the authorized plant protection products. Plant protection products on the market, the authorization of which expires within two years from the date of entry into force of this Law and the active substance of which is not on the list of active substances approved at the European Union level, shall be authorized for a period of no more than 5 years from the expiry of the authorization”.
