Abstract
This Regulation does not apply to: (a) contaminants that are significant only for the quality of food products, but are not significant for public health; alien bodies, such as insect fragments, hair of animals and others; (b) microbial toxins, such as botulinum toxin and staphylococcal enterotoxin, as well as microorganisms; (c) technological assistants; and (d) other contaminants that are the subject of specific normative acts. Food products placed on the market must not contain contaminants in quantities that exceed the maximum levels established by this Regulation. The maximum levels specified in the annex to this Regulation apply to the edible part respective food products. In the case of applying the maximum levels, established in this Regulation, to food products that are dried, diluted, processed or composed of more than one ingredient, the following are taken into account: (a) modification of the concentration of the contaminant through drying or dilution processes; (b) changing the concentration of the contaminant through processing; (c) the relative proportion of the ingredients in the product; and (d) the analytical limit of quantification. The specific concentration or dilution factors for drying, dilution, processing and/or mixing operations or for dry, diluted, processed and/or compound food products shall be provided or justified by the food business operator, when the competent authorities carry out state controls. In case the food business operator does not provide the necessary concentration or dilution factor or the competent authorities consider the factor inadequate from the point of view of the justification provided, the authorities themselves define this factor based on the existing information and the criteria specified in item 6 of this Regulation, having as objective the maximum protection of human health. Food products that do not fall within the maximum levels provided in the annex are not used as food ingredients. Food products falling within the maximum levels set out in the annex shall not be mixed with food products exceeding these levels. Food products to be subjected to sorting or other physical treatments for reducing contamination levels do not mix with food intended for human consumption or with foodstuffs intended for use as food ingredients. Food products containing contaminants mentioned in the annex (Mycotoxins) shall be detoxified through chemical treatments.
