Governmental Decree No. HG695/2020 validating the Regulation on the procedure for the acknowledgement of groups of agricultural producers.

This Governmental Decree establishes: (a) the procedure for the creation and functioning of the Сomission for the acknowledgement of groups of agricultural producers; and (b) the procedure for the acknowledgement of groups of agricultural producers constituted in compliance with the acting legislation. The status of a group of agricultural producers shall be attributed by issuance by the Ministry of Agriculture, Regional Development and Environment of conclusions on acknowledgement. Сomission for the acknowledgement of groups of agricultural producers performs the following tasks: (a) examines applications for recognition of groups of agricultural producers; (b) checks the correctness of the information provided in the package of documents in compliance with the acknowledgement requirements; (c) considers the decision of the Agency on interventions and payments in agriculture on the plan for the acknowledgement of a group of agricultural producers; (d) ascertains the violations found in the package of documents and requires their elimination; (d) invites the competent authority to issue a confirmation of the acknowledgement of a group of agricultural producers or rejects an application for acknowledgement; (e) considers requests from groups of agricultural producers to make changes to the acknowledgement plan; (f) considers the Agency on interventions and payments in agriculture annual report on the implementation of the plans for acknowledgement of groups of agricultural producers; (g) considers the Agency on interventions and payments in agriculture proposals to withdraw the notification of acknowledgement with the issuance of an appropriate decision; and (h) recommends to include in the List of Prohibited Beneficiaries of Subsidies, kept by the Agency on interventions and payments in agriculture, of acknowledged groups of agricultural producers whose acknowledgement has been cancelled. Administrator or representative of a group of agricultural producers, acting under a power of attorney issued by the administrator submits to the competent authority application for acknowledgement of a group of agricultural producers and accompanying documents. The decision to approve or reject the acknowledgement shall be made by the Agency on interventions and payments in agriculture within 20 days from the date it was receipt.
