Abstract
This Act establishes the Mauritius Standards Bureau and defines the following relevant terms: certificate of registration; code of practice, as the practices and procedures to be applied for the design, manufacture, installation, maintenance or utilisation of equipment, structures or products; compulsory standard; conformity assessment; general fund; certification mark; measurement standard; standard; technical investigation. The Act specifies the following objects of the Bureau: promoting and encouraging standardisation and conformity assessment in industry and trade; promoting Mauritian standards in relation to any goods, article, process, system or service; promoting technological development in industry through applied research. The Act specifies the following functions of the Bureau: establishing, publishing, amending and revising Mauritian Standards; adopting any standard or any other publication or research work, in relation to any goods, article, process, system or service; undertaking, supporting and promoting such research as may be necessary or required for the formulation of Mauritian Standards; monitoring the certification marks; assessing and monitoring management systems; inspecting, examining, analysing materials, documents, products and services; developing, holding and maintaining the national measurement standards through traceability to the Système International d’Unités; verifying measuring apparatus and instruments; providing technical information on standardisation and related subjects; conducting technical investigations and inspection services in the field of conformity assessment.
The Act concerns the following matters: powers of the Bureau; appointment of members of the Standards Council; appointment of employees; protection of members and employees from civil and criminal liability; ministerial powers in relation to the exercise by the Council of its powers; establishment of a general fund and charges to the Fund; standardisation and conformity assessment; role of technical committees; standards established by the Bureau; copyright of Mauritian Standards; issuing, suspension and revocation of MSB certification mark; certificate of registration and registered firm symbols; metrology and calibration; offences; enforcement measures; protection against claims.
