Abstract
This Act makes provision for the protection of plants and planting material from pests and diseases and for this purpose establishes within the Ministry of Agriculture a National Plant Protection Office (NPPO) which shall be the authority responsible for the enforcement of this Act in Mauritius.
The functions of the NPPO shall include: (a) the implement the obligations of Mauritius under the International Plant Protection Convention;(b) to issue phytosanitary certificates; (c) to propose, review and enforce phytosanitary measures; and (d) to advise the Minister.
The Act imposes duties on owners of land or any building or other structure situated on land regarding the containment and eradication of pests, grants power to the Minister to declare pest quarantine areas and to authorized officers to impose control measures for quarantine areas, provides with respect to the monitoring of pests, provides with respect to phytosanitary measures for imports and exports of plants, plant products and other regulated articles, contains rules relative to enforcement and prescribes offences.
