Abstract
The present Act, which consists of four Parts and two schedules, provides for the setting up of the Federal Agricultural Marketing Authority (hereinafter “the Authority”). Section 3 lays down with full details the functions which are entrusted to the Authority, such as: (1) co-ordination of activities in respect of the marketing of the agricultural produce; (2) search and promotion of new markets and outlets for agricultural produce; (3) promotion and development of efficient and effective management of agricultural enterprises dealing in or processing agricultural produce; (4) engaging in agricultural enterprises dealing in or processing agricultural produce. To attain all these objectives, the Authority shall have the power to: (a) regulate the marketing of any agricultural produce; (b) prohibit, regulate or control the movement of any agricultural produce; (c) prescribe the grading, packaging and sealing of any agricultural produce and to issue certificates in respect thereof; (d) deal in agricultural industry equipments; etc. The Authority shall submit every year the Ministry charged with the responsibility for agriculture a report relating to the activities carried out by the Authority itself during the preceding year (Section 11). Part III of the Act regulates the powers related to enforcement which may be entrusted to any public officer or officer of the Authority by the Minister upon written authorization. Part IV sets forth offences, penalties and proceedings.

An Act to incorporate the Federal Agricultural Marketing Authority to supervise, co-ordinate and improve the marketing of agricultural produce in Malaysia including the importing and exporting of agricultural produce, to provide credit facilities for such marketing and for matters connected therewith.
