Abstract
An Act relating to all aspects of fisheries and fish conservation, providing a framework for further regulation of inland and marine fisheries.
The text consists originally of 57 sections which are now divided in 8 Chapters: General provisions (I): The registration of fishing crafts (II); The observance of international obligations contracted by the Netherlands (IIa); Sea fisheries (III); Coastal fisheries (IV); Inland fisheries (V); Penal provisions (VI); Transitional and final provisions (VII).
Article 2a makes provision for the further regulation of closed seasons, minimum size of fish, and other fisheries conservation and management measures by cabinet Order. The Minister may further regulate the farming or processing of and trade in fish for purposes of prevention or eradication of fish diseases (art. 2b). Article 2c concerns the use of fishing methods other than those prescribed by the Minister. Regulation of registration of fishing vessels shall be done by cabinet Order. Article 3a contains rules relative to the observance of international obligations contracted by the Netherlands. International obligations may be transposed into Dutch law by a General Order of the Minister. All sea fisheries shall be regulated by Cabinet Order (art. 4). Article 5 prohibits foreign fishing vessels to fish in waters inside the fisheries zone unless such fishing is allowed by Cabinet Order. Coastal fisheries is prohibited in areas covered by a licence issued to another vessel, unless authorized by the licence holder or acting in support of fishing activities of the licence holder (art. 7). Inland fisheries is regulated in more detail in sections 10 to 36. Article 38 establishes an organization for the improvement of inland fisheries and an Inland Fisheries Tribunal. The organization shall enhance inland fisheries through financing of development projects and through other measures.
