Abstract
This Regulation amends certain articles of Regulation No. 922. The quality of petrol and diesel, omitting biofuel provisions (article 20.2); inserting provisions on the turnover requirement for biofuels and sustainability criteria for biofuels and liquid biofuels with a minimum of 3.5% by volume of the total traded quantity of fuel used in a year (3.3); double counting of certain types of biofuels produced from waste and residues, lingo-cellulosic material, or cellulose-containing material that is not food (3.4); on the reduction of greenhouse gas emissions by a minimum of 35%. From 1 January 2017, the emission reduction shall be at least of 50%. Biofuels with production starting 1 January 2017 or later will have a greenhouse gas reduction of 60% from 1 January 2018. Reduction in greenhouse gas emissions should be calculated according to the methodology described in Annex I, II and IV (3.6). Biofuels shall not be made from raw materials from areas with one of the following conditions as of 1 January 2008: forestry, areas under environmental conservation, grassland with high biodiversity (3.7). Raw materials from agriculture within the European Economic Area and used for the production of biofuels in accordance with the requirements and standards in the provisions referred to in paragraphs 1-5 and 9 of Annex II to Council Regulation (EC) No. 73/20091 of 19 January 2009 and Article 6 of the same Regulation (3.9).
Annex I - Calculation of life cycle greenhouse gas emissions from biofuels and liquid biofuels.
Annex II. Rules for calculating the impact on greenhouse gases from biofuels, liquid biofuels and fossil fuels equivalent to the comparable:
A. Default values for biofuels produced with no net carbon emissions resulting from land use change.
B. Computed default values for future biofuels that in January 2008 were unavailable on the market, or only in negligible amounts, and produced no net carbon emissions resulting from land use change.
C. Methods.
D. Disaggregated default values for biofuels and liquid biofuels.
E. Estimated disaggregated default values for future biofuels and liquid biomass which in January 2008 were unavailable on the market, or were in negligible amounts.
Annex III. Conditions may apply to voluntary measures.
Annex IV. Guidelines for estimating carbon stocks in soil - under Annex V to Directive 2009/28/EC.
