Abstract
These Regulations are made in exercise of powers granted by section 44 of the Pesticides Management Act, 2076 (Act No. 7 of 2019). These Regulations provide for the procedure for application for registration of pesticides, the criteria and conditions for such application and the approval of application made. The conditions for suspension or revocation of registration are also provided. Further, the provisions relating to licensing of registered pesticides for production, synthesis, export, import, transportation, distribution or re-distribution, and sale are laid down. The duties, functions and powers of the Pesticides Management Committee (Committee), in addition to those mentioned in the Act are given (Reg 14). The functions, duties and powers of the Plant Quarantine and Pesticides Management Centre (Centre), in addition to those mentioned in the Act, are laid down (Reg 15).
Regulation 17 states that in order to prevent the indiscriminate use of pesticides, the Food Administration and Quality Control Department under the Food Law shall, in coordination with the competent authorities, monitor the quantity of pesticide residues in food products, to ensure that the pesticide residue levels do exceed the prescribed limit. The standards for pesticide use and safety are provided which require the purchasers of pesticides be informed about the precautions to be taken when using pesticides, the harmful effects of indiscriminate use of pesticides and measures to be taken in case of accidents (Reg 18). Provisions for registration of homemade and biopesticides are also made.
Regulation 21 requires individuals or organizations producing or synthesizing pesticides to conduct environmental impact assessment and submit the report to the Centre. The personnel involved must follow safety measures and get regular health examinations done. Regulation 22 provides for recommendation to be made by the Centre to the Committee for restrictions on use of a pesticide in certain cases. Regulation 23 makes provisions in respect of management of expired pesticides. The functions, duties and powers of inspectors, in addition to those provided in the Act, are laid down (Reg 25). The records in respect of manufacture, import, export, sale, distribution of pesticide must be maintained and submitted to the Centre periodically (Reg 26). Further, provisions for testing of pesticides and collection of samples for pesticide residue analysis are made. Regulation 30 lays down the procedure for compensation in case of accidents relating to pesticides.
