Abstract
This Act provides for the regulation and management of manufacture, export, import, storage, sale, distribution, transportation, use and disposal of pesticides in Nepal. It consists of eight chapters: 1. Preliminary; 2. Registration of Pesticides; 3. Provision Relating to the License; 4. Formation and Functions, Duties and Powers of the Committee; 5. Registration and Management Centre; 6. Use and Management of Pesticides; 7. Offence, Punishment and Compensation; and 8. Miscellaneous.
Chapter 1 contains the short title and definitions. Chapter 2 requires registration of pesticides before manufacture, synthesis, export, import, commercial use, storage, sale, distribution, transportation, packaging or re-packaging. The use of unregistered pesticides is prohibited. The registration may be suspended or revoked if any pesticide causes adverse impact on human health, animal or plant health and the environment. Chapter 3 provides for licensing of pesticides that are registered before undertaking any of the activities mentioned therein. The validity of such license shall be three years. Chapter 4 establishes a Pesticides Management Committee (Committee) to advise the Government of Nepal on matters related to the management of pesticides. The composition, functions, duties and powers of the Committee are laid down. Chapter 5 establishes the Plant Quarantine and Pesticides Management Centre (Centre) for the control, regulation, registration and management of pesticides. The functions, duties and powers of the Centre are provided.
Chapter 6 contains provisions relating to use and management of pesticides. It restricts use of pesticides in a haphazard manner and states that residue must not exceed the specified level. Sellers of pesticides must also put on sale safety gear to be worn while using or disposing pesticides. A pesticide shall be used only for the purpose for which it has been registered under this Act. Production and use of organic pesticides is encouraged. Provisions for management of expired pesticides is also made. The appointment of inspectors and their functions, duties and powers are laid down. Chapter 7 provides for the offences, penalties and compensation. Chapter 8 makes provisions for formation of provincial management committees, monitoring by Centre, assistance to inspectors by local administration, storage for seized pesticides, and framing rules, directives and standards as necessary.
