Abstract
This Royal Decree issues the Agricultural Quarantine Law. The Ministry of Agriculture and Fish Resources shall issue the implementing Regulations for this Law.
The Law is composed of 33 articles and 2 Annexes. Terms and definitions are included in Article 1. This Law aims to: prevent the introduction of agricultural epidemics and diseases into the Sultanate of Oman; protect the environment and plant resources; and facilitate commercial activities (art. 2). Article 3 covers the following duties of the competent Authority: (a) to issue declarations by which the quarantine is established or revoked; (b) to prevent the introduction into the Sultanate of Oman of all quarantine diseases and epidemics; (c) to regulate the exportation of plant and plant products; (d) to recommend the selection of a quarantine site; (e) to prevent the transfer of quarantine epidemics and diseases from one country to another; (f) to carry out necessary analysis for dangerous and hazardous diseases and epidemics; (g) to control diseases and epidemics existing in Oman; (h) to cooperate and collaborate with international and regional organizations in the field of quarantine and plant protection; (i) to prepare training courses, meetings, conferences and workshops concerning plant protection; (j) to prepare a guide for the importation and exportation of plants; and, (k) to publish information about hazardous and dangerous diseases and epidemics. The Minister of Agriculture and Fish Resources will issue a Resolution for the nomination of officers and inspectors to apply this Law (art. 4). Article 5 defines duties of the aforementioned Officers and Inspectors. Article 8 covers the control, limitation and eradication of diseases and epidemics. Articles 9-12 set out duties carried out by the Minister of Agriculture and Fish Resources, or the competent Authority, in case of the entry of an epidemic or a disease in Oman or in case of emergency. Articles 13-26 concern the requirements, conditions, measures, documents, licences and the like necessary for the importation and exportation of plants. Articles 27-29 provide for offences, penalties and the liability. The Minister of Agriculture and Fish Resources shall issue a Resolution defining the licence fees, plant sanitary certificates and plant sanitary services (art. 30).
