Abstract
This Act consists of the following Sections: General provisions (sec. 1); Trade in and use of biocide products (sec. 2); Marketing of biocide products (sec. 3); Active substances (sec. 4); Using data of another mover (sec. 5); Package, classification and marking of biocide products (sec. 6); Advertising of biocide products (sec. 7); Research and development examination (sec. 8); Inspection (sec. 9); Inspection of poisoning (sec. 9a); Principles of acceptance of permissions and registration between member states of the European Union (sec. 10); Criminal liability (sec. 11); Final provisions (sec. 12). The Act establishes: (a) conditions of placing on the market and use of biocide products on the territory of the Republic of Poland; (b) principles of acceptance of mutual recognition of permissions for marketing and registration of biocide products of low risk between Poland and other member states of the European Union. The aim of the Act is to prevent human and animal health as well as danger of the environment from results of biocide products. A biocide product is defined as an active substance or preparation containing at least one active substance, in forms as provided to the user, intended for destroying, deterring, neutralizing, preventing or controlling of dangerous organisms by chemical or biological effect.
