Decree-Law No. 38/2015 implementing Law No. 17/2014 establishing the Policy on the National Maritime Areas Planning and Management.

This Decree-Law, consisting of 8 Chapters divided into 109 articles and 2 Annexes, implements Law No. 17/2014, establishing the Policy on the National Maritime Areas Planning and Management (LBOGEM). It defines the following sectors: regime of drafting, approval, modification, revision and suspension of planning instruments for national maritime space; legal regime applicable to private use holders of the national maritime space; economic and financial regime associated with the private use of the national maritime space; permanent monitoring system and technical evaluation of the national maritime spatial planning; private use of water resources regime in transitional waters for aquaculture purposes. It is divided as follows: National maritime spatial planning instruments (II); Use of the national maritime space (III); Economic and financial regime (IV); Assessment of the state of national MSP (V); Inspection and offences (VI); Private use of transitional waters for aquaculture purposes (VII); Final provisions (VIII).
