Decree-Law No. 39/2018 establishing the regime for the prevention and control of emissions of pollutants into the air, and transposes EU Directive 2015/2193.

This Decree-Law establishes the regime for the prevention and control of pollutant emissions into the air, transposing Eu Directive No. 2015/2193, of the European Parliament and of the Council of 25 November 2015, concerning the limitation of emissions into the atmosphere of certain pollutants from medium-sized combustion plants. This decree-law is applicable to sources of emission of pollutants into the air associated with the following installations, complexes of installations and activities: a) Combustion installations, with a nominal thermal power equal to or greater than 1 MW and less than 50 MW, referred to as “medium combustion plants” (MIC), regardless of the type of fuel used; b) Complexes made up of new MICs referred to in paragraph 1 of part 1 of Annex III to this decree-law, of which it forms an integral part, including the complex in which the total nominal thermal power is equal to or greater than 50 MW, except if this complex constitutes a combustion plant covered by chapter III of Decree-Law no. 127/2013, of 30 August, in its current wording; c) Industrial activities, under the terms set out in part 2 of annex I to this decree-law, of which it forms an integral part; d) Combustion installations that burn refinery fuels, alone or together with other fuels, for the production of energy inside oil and gas refineries; e) Furnaces and burners for industrial activities, with a thermal power equal to or greater than 1 MW and less than 50 MW.
