Abstract
Regulations promulgated by the Republic of Palau Environmental Quality Board (“the Board”). They give further meaning to provisions of the Environmental Quality Protection Act of Palau by providing agencies and persons with procedures, specifications of contents and other rules regarding the preparation, filling and distribution of environmental impact statements. “Environmental impact”, “environmental assessment” and “environmental impact statement” are defined in regulation 2. Regulations 3 and 4 define the applicability of the requirement of an environmental assessment. An environmental assessment shall contain information set out in regulation 5. On the basis of this environment assessment the Board shall determine whether the preparation of an environmental impact statement in accordance with regulations 8 to 14 is required (reg. 7). Regulations 15 to 19 concern filing and distribution of a draft environmental impact statement. The Board shall be responsible for notification of the draft statement to the public and distribution to reviewers, i.e. persons and agencies that have jurisdiction or expertise to review the draft. Regulation 17 prescribes the period of public review of the draft. A draft shall be accepted or rejected by the Board in accordance with regulation 18 and a notice to that effect issued to the applicant. Remaining regulations make provision for supplemental statements, public notice of statements and environmental impact fees. (26 regulations)
