Order No. 60/2017 of the Ministry of Agriculture and Rural Development on access to living aquatic resources in the public domain of the state for the purpose of recreational fishing in natural habitats with the exception of the Danube Delta Reserve.

This Order of the Ministry of Agriculture and Rural Development, which refers to articles 2, 9, 23 and 56 of the Emergency Ordinance on fisheries and aquaculture of 2008 (as amended), provides with respect to the granting of fishing permits for non-commercial fishing. Granting of recreational fishing rights in natural fish habitats in Romania, with the exception of the Danube Delta Biosphere Reserve, is the responsibility of the National Fisheries Agency and Aquaculture (ANPA) and shall be done on the basis of a nominal permit issued by ANPA or issued on behalf of ANPA by legally established associations fishermen for recreational purposes, as appropriate, without any fees or charges. Specific rules apply to permits directly granted to single fishermen or permits granted to (members) of recognized fishermen associations on the basis of a contract. The Order sets out the requirements for the application for a fishing permit or contract. Criteria for evaluation of applications are set out in Annex 4. The model of the nominal fishing permit released by fishing associations for recreational purposes is reproduced in Annex 1, whereas the model for nominal fishing permits is reproduced in Annex 2. Annex 3 reproduces a model management plan for recreational fishing association.
Associations of recreational fishermen who have signed contracts for use aquatic resources for recreational purposes with ANPA have the obligation to restore the living aquatic resources natural fish habitats through fish brood populations. Species and quantities of juvenile fish shall be established by contract and additional acts. Failure to comply with the obligation to restore fish stocks shall result in the termination of the use of the contract.
