Abstract
This Law regulates the production, production control, processing, quality, packaging, labelling, placing on the market, post-control testing and inspection, and import of certain groups and types of seeds and planting material of agricultural and ornamental plants, as well as other issues of importance for the field of seeds and planting material of agricultural and ornamental plants. The provisions of this Law shall apply to groups and types of seeds and planting material of agricultural and ornamental plants, namely: cereals, industrial plants, beets, potatoes, fodder plants, vegetables, fruit, vines, hops, as well as to ornamental plants, the seeds and planting material of which are produced and placed on the market. The Minister responsible for agricultural affairs shall prescribe the types of agricultural and ornamental plants. Laboratory and related professional tasks for testing the quality of seeds and planting material, as well as issuing seed certificates, are performed by the administrative body within the Ministry - the Directorate for National Reference Laboratories established by the law regulating food safety.
The text is divided into ten main thematic Chapters and a total of 98 articles. Titles of these Chapters are as follows: I. Basic provisions; II. Seeds; III. Planting materials; IV. Post-control testing of seeds and planting material; V. Import control of seeds and planting material; VI. Data collection, use and exchange; VII. Supervision; VIII. Penalty provisions; IX. Alignment with the European Union acquis; and X. Transitional and final provisions. This Law is consistent with all the principles prescribed in EU legislation as listed in article 89. From the date of accession to the European Union, the competent national Ministry shall submit to the European Commission the regulations adopted on the basis of this Law, enable inspections and conduct control tests on seeds and planting material.
The tasks of testing the quality of seeds and planting material referred to in Article 6, paragraph 2, item 4) of this Law and the tasks of issuing seed certificates referred to in Article 6, paragraph 2, item 6) of this Law may also be performed by an accredited laboratory selected through a competition and with which a contract has been concluded (hereinafter: authorized laboratory), in accordance with this Law. The Republic of Serbia shall, within its powers, ensure the activities in the field of seeds and planting material through the Ministry, as well as other entities, in accordance with this Law. The Ministry shall perform the following activities: 1) establish and maintain a register in the field of seeds and planting material; 2) control of the production of seeds and planting material; 3) issue certificates of recognition of seed crops and certificates of production of planting material; 4) quality testing of seeds and planting material; 5) issue labels for seeds and planting material; 6) issue certificates for seeds; 7) post-control testing of seeds and planting material.
