Regulation on the method of exercising the right to basic incentives in plant production and the request form for the exercise of those incentives.

This Regulation sets the manner of exercising the right to basic incentives in plant production, as well as the form of request for the realization of those incentives. The right to incentives is exercised by a legal entity, an entrepreneur and a natural person - the owner of a commercial family farm, which is: 1) registered in the Register of Agricultural Farms in accordance with the law regulating agriculture and rural development and is in an active status; 2) before submitting a request for exercising the right to incentives in accordance with this Regulation, renewed the registration for the current year in the Register, in accordance with a special regulation regulating registration in the Register of agricultural holdings, data changes and registration renewal, electronic processing, as well as conditions for the passive status of an agricultural holding. These person realizes the right to incentives based on the area of plant production: 1) for sown, i.e. planted and registered in the Register of areas under appropriate plant culture in accordance with the Code of Crop Production and Other Uses of Land Plots, which is an integral part of the regulations on the registration of agricultural holdings (Code of Crop Production), except for natural meadows and pastures within the group of fodder crops, as well as uncultivated land; 2) up to a maximum of 100 ha; 3) which it processes in its own name and for its own account. These persons cannot exercise the right to incentives for areas of state-owned agricultural land that it leased, that is, for use, except for state-owned agricultural land that it leased at a public tender in accordance with the law which governs agricultural land.
