Abstract
The present Federal Law regulates relations connected with ownership, land tenure and disposal of the plots of agricultural land, sets use restrictions applicable to transactions with the plots and shares in common property of agricultural land out of which land rights shall originate or cease, determines the terms and conditions of allotment of the plots of agricultural land pertaining to public or municipal property, and also the modalities of expropriation thereof for public and municipal needs. The provisions of the present Federal Law are not applicable to the plots of agricultural land allotted to citizens for personal subsidiary small-holding, gardening, truck farming and animal breeding. The turnover of agricultural land shall be based on the following principles: (a) preservation of specific use of land plots; (b) setting the maximum size of the total area of agricultural land, located within the same municipal area that may be owned by one citizen and/or one legal entity; (c) preferential right of a constituent entity of the Russian Federation or in cases, established by the law, of a municipal unit for purchase of a plot of agricultural land when it is sold, except in cases of public sale; (d) preferential right of other participants of share ownership to land parcel or using land parcel of agricultural organization or a citizen who is a member peasant farms to purchase a share in the common ownership in the event of a compensatory disposition of such interest by the participant of shared ownership; and (e) establishment of particulars of granting agricultural land plots to foreign nationals, foreign legal persons, stateless persons, as well as legal entities, in the statutory (share) to the capital of which the share of foreign citizens, foreign legal entities or stateless persons is more than 50 percent.The Federal Law consists of 4 Sections composed of 20 articles. Section 1 (arts. 1-7) lays down general provisions. Section 2 (arts. 8-11) specifies the particulars of turnover of the plots of agricultural land. Section 3 (arts. 12-14) establishes the particulars of turnover shares in common property to agricultural land. Section 4 (arts. 15-20) lays down transitional and final provisions.
