Abstract
This Code regulates the accomodation and housing of the popul ation, urban and rural planning, the development of engineering, transport and s ocial infrastructures, rational use of the natural resources and environmental protection for the benefit of tenants. This Code defines the competence of the executive authorities, of the regional authorities, the rights and the duties of physical and juridical persons in the field of urban construction, the role of do cumentation and regulations in the field of the land use and establishes the lia bility for the infringement of the Russian Legislation on urban construction. This Code is composed of XVI Chapters divided into 73 articles.
Chapter I lays down General Provisions (arts. 1-6). Chapter II deals with the endorsement of the guarantees of the citizens to the suitable environment for their living and working activity (arts. 7-20). Chapter III establishes the competence of the central executive authorities and the competence of the local administration in the sphere of urban construction (arts. 21-23). Chapter IV establishes the structure of the executive authorities and the local administration in the field of regulation of urban construction and their competence (arts. 24-27). Chapter V regards the documentation on urban construction, planning, land development and construction within residential areas (arts. 28-30). Chapter VI concerns urban planning and land development of the territory at the federal and local level (arts. 31-33). Chapter VII regards urban, rural, municipal planning and land development (arts. 34-37). Chapter VIII regulates the use of land for the construction purpose within urban and rural residential areas (arts. 38-48). Chapter IX regulates the use of land in suburban areas for the construction purpose (arts. 49 and 50). Chapter X establishes standards and regulations for urban construction (arts. 51-53). Chapter XI regards urban cadastre and monitoring of edifices (arts. 54 and 55). Chapter XII formulates urban and rural construction planning (arts. 56-64). Chapter XIII regards the supervision of urban construction and establishes the liability for the infringement of the Russian Legislation in point of law (arts. 65-67). Chapter XIV specifies the economic basis for urban construction (arts. 68-70). Chapter XV deals with international cooperation in the field of urban construction (art. 71). "Urban Code" of the Russian Federation was ratified by the State Duma (Lower Chamber) of the Federal Assembly (Parliament) of the Russian Federation on 8 April 1998 and was approved by the Council of the Federation (Upper Chamber) of the Federal Assembly (Parliament) on 22 April 1998. This Code invalidates Law of the Russian Federation of 1992 "Basic urban construction legislation", Federal Law of 1995 "On amendments to the article 5 of the Law of the Russian Federation "Basic urban construction legislation"", Decree of the Supreme Soviet of the Russian Federation of 1992 "On carrying into effect of the Law of the Russian Federation "Basic urban construction egislation", modifies Article 143 of the "Code of administrative offences of the RSFSR" of 1984, regarding the unauthorised construction. The abbreviation RSFSR stands for Russian Soviet Federative Socialist Republic. The Russian Federation is the successor of the RSFSR. The President of the Russian Federation is entitled and the Government of the Russian Federation is compelled to conform their Regulations and Legislative Acts to this "Urban Code".
