Abstract
The Government decrees as follows: 1) keeping of live animals of the species recorded in the Red Book of the Russian Federation is permitted only for the purpose of stock enhancement and repopulation of the aforesaid species in the artificially created habitats and for scientific research and recreation; 2) release of wildlife species recorded in the Red Book of the Russian Federation into natural habitats is carried out for the purpose of their conservation and (or) stock enhancement of the aforesaid species; 3) the right to management of wildlife species recorded in the Red Book of the Russian Federation is transferable on the basis of permit (administrative licence); 4) the Ministry of Environmental Protection and Natural Resources is authorized to issue permits (administrative licence) for the management of wildlife species recorded in the Red Book of the Russian Federation; 5) to validate the Regulation on the modalities of issuing permits (administrative licences) for the management of wildlife species recorded in the Red Book of the Russian Federation. The Regulation specifies the list of documents to be forwarded by physical and juridical persons to the Ministry for obtaining the permit (administrative licence). Permit (administrative licence) can determine also the conditions for keeping of live animals, the modalities of their release into the natural habitat and impose other conditions in compliance with the requirements for the protection of wildlife species recorded in the Red Book of the Russian Federation. The decision on issuing licence or refusal must be made within 30 days on receipt of the application form complete with all the necessary documentation. Notification of the refusal of issuing permit (administrative licence) must be forwarded to the applicant in a written form within 3 days after the decision specifying the reasons for refusal. The ministerial decision of refusal can be appealed against into court in the established manner.
