Abstract
This Law is composed of 3 chapters divided into 10 articles . Chapter 1 deals with preliminary provisions in particular: the name of the Law and its entry into force; abrogation of the Law on pesticides of 1974; and terms and definitions. Chapter 2 decrees the creation of the National Council for Pesticides, Pesticide Products and Pest Control (NPC) and defines its functions and duties. Chapter 3 contains concluding provisions especially: prohibition of some activities; prohibition of use and circulation of bad, rotten and adulterated pesticides; offences and penalties; and the issuance of the Implementing Regulation.
The established National Council for Pesticides has the following main tasks pertaining to insecticides and pest control products (i) establish the register; (ii) examine and evaluate; (iii) adopt recommendations of technical committees concerning the testing results; (iv) register, re-register or revoke the registration; (v) license and/or revoke the license for their manufacturing, preparation and trading; (vi) license importation and exportation; (vii) monitor the disposal of the surplus and utensils thereof; (vii) proscribe and restrict the use thereof; and (viii) (i) establish a body for inspection, control and analysis, oversee the same and organize the business thereof. Furthermore, the Law prohibits (i) manufacture, pack, store, transport, distribute, use or advertise any of the insecticides and pest control products; (ii) place any label on any of the insecticides and pest control products in a misleading way; (iii) deal in any unfit or adulterated products; (iv) import to the Sudan or sell therein any unregistered, unpacked or unlabelled products.
