Abstract
This Law defines the legal, organizational and economic bases of quarantine and plant protection, application of quarantine phytosanitary measures, handling plant protection products (agrochemicals, fertilizers, nutrients, and pesticides) and is aimed at preserving agricultural products, protecting human and animal, and ensuring environmental security. Plant quarantine is implemented on the basis of the adoption and application of regulatory legal acts and technical regulations in the field of plant quarantine, the implementation of quarantine phytosanitary measures and the implementation of state quarantine phytosanitary control. Plant protection shall be performed in compliance with the following requirements: (a) adoption and application of regulatory legal acts and technical regulatory acts, as well as other methodological documentation in the field of quarantine and plant protection; (b) determination of biological effectiveness and establishment of regulations for the use of pesticides and agrochemicals; (c) organization of manufacturing of pesticides and agrochemicals, implementation of plant protection measures; (d) creation and use of a reserve fund of pesticides and agrochemicals; and (e) formation and use of the state database on plant protection. The main objectives of the state policy in the field of quarantine and plant protection are: (a) development and implementation of the concept, program and plan of relevant activities; (b) legal and technical regulation in the field of quarantine and plant protection; (c) ensuring a favorable phytosanitary environment and food security; (d) ensuring the safety of people, livestock and the environment in the implementation of quarantine phytosanitary and plant protection measures; (e) quarantine phytosanitary monitoring; (f) state quarantine phytosanitary control and plant protection; and (g) implementation of other measures for quarantine and plant protection. Physical persons and legal entities that produce, store import and export, manage and trade material subject to quarantine inspection must: (a) comply with the requirements of regulatory legal acts and technical regulatory acts; (b) ensure unimpeded entry by officials of the authorized state body into regulated facilities and provide them with the necessary information and documents; (c) inform the authorized state body on the import of regulated material and the place of its storage; (d) ensure the neutralization or destruction of sources of quarantine pests in case of their detection; (e) follow quarantine regulations; and (f) use in the transportation of regulated materials means and methods that do not contribute to the focal spread of quarantine pests. Physical persons and legal entities operating in the field of plant protection, must: (a) comply with the requirements of regulatory legal acts and technical regulatory acts in the field of plant protection; (b) assist officials of the authorized state body in the performance of official duties in accordance with the requirements of this Law and other regulatory legal acts of the Republic of Tajikistan, ensure timely submission of information and documents necessary for state control; (c) follow the safety rules for handling pesticides and agrochemicals; (d) use pesticides and agrochemicals listed in the State Register; (e) store pesticides and agrochemicals in special storage facilities and dispose of pesticides that are prohibited from use, expired and (or) unsuitable for use, as well as containers from them, in a manner approved by an authorized state body; (f) make mandatory payments for the provision of plant quarantine or laboratory tests, inspections, quarantine material examination, phytosanitary certification, fumigation, degassing, issuance of permission for quarantine import of phytosanitary certification, pesticides, agrochemicals and other measures to be checked. This Law consists of 8 Chapters divided into 37 Articles. Chapter 1 lays down general provisions. Chapter 2 regards state management in the field of quarantine and plant protection. Chapter 3 regards the system for ensuring quarantine and plant protection. Chapter 4 regards management of pesticides and agrochemicals. Chapter 5 regards registration, accountability and scientific research in the field of quarantine and plant protection. Chapter 6 regards state supervision in the field of quarantine and plant protection. Chapter 7 regards international cooperation. Chapter 8 lays down final provisions.
