Abstract
The purposes of this Act are: (I) to provide a coherent institutional and regulatory framework for the management, planning and co-ordination of the energy sector in Tonga; (II) to establish clear national objectives for the energy sector and ensure that those national objectives are achieved; (III) to establish and clarify the functions and powers of the Ministry, Energy Advisory Committee, Energy Commission and other bodies established under this Act;(IV) to provide for the development of relevant standards for the energy sector and for the regulation of energy services; and (V) to promote private sector incentives and research initiatives.
This Act lays down provisions on the general administration and the functions of the Minister and Chief Executive Officer; development of a national energy policy; registration of energy industry associations; establishment and functions of the Energy Advisory Committee; establishment, functions and powers of the Energy Commission; regulation of the energy sector, including renewable energy; concession contracts; administration and maintenance of energy assets; safety and environmental standards; minimum energy performance and labelling standards; inter-agency cooperation; capacity building; private sector incentives; collection of fees, levies and charges; publication and dissemination of regulations and standards; enforcement; and offences and penalties.

Entry into force notes
This Act shall come into force on the date of gazettal, except for the Division Three of Part VI (Price Regulation) and Part IX (Administration and Maintenance of Energy Assets), which shall come into force on a date proclaimed by Cabinet and published in the Gazette.
