Abstract
This Regulation sets forth rules and procedures on protecting the rights of fertilizer importers, and inspection of chemical fertilizers to ensure their compliance with international and national standards.
Procedures for carrying out of market inspections with respect to the specifications of the fertilizers to be placed on the market and labelling of packaging are given in detail. Market inspections are carried out on a regular basis, but also following a complaint. The Provincial Directorates of Agriculture shall act as inspecting agencies. Instruments of technical analysis and methods of inspection are set out in detail. The names of authorized laboratories, carrying out the initial analysis and the final analysis if an objection is lodged, are determined by the Ministry of Agriculture and Rural Affairs on annual basis. Depending on the outcome of analysis made, the Ministry of Agriculture and Rural Affairs may take legal and/or administrative actions against the importers, distributors, wholesalers and retailers of the chemical fertilizer concerned. Importers of chemical fertilizer shall obtain an import licence from the Ministry of Agriculture and Rural Affairs. Rules and procedures for obtaining a licence are given in this Regulation.
