Abstract
The Air Pollution Rules provide a comprehensive framework for managing air quality and mitigating the adverse effects of air pollution in Trinidad and Tobago. These rules specify the responsibilities of applicants, operators, and permit holders, and describe the bubble approach for emissions control. The rules emphasize the importance of maintaining air quality and managing emissions from various facilities and activities listed in the schedules. These Rules also detail the procedures for obtaining permits, registering emitter facilities, and maintaining records. The Authority shall maintain a register of air pollutants to be called the Register of Air Pollutants. It shall also set out (i) the air pollutants permitted to be released and (ii) the quantity, conditions and concentrations of the air pollutants that the operator may release, in each permit. These Rules highlight the roles of local authorities and the requirements for emergency situations. The rules aim to protect sensitive receptors and ensure that air pollutants do not exceed the maximum permissible levels. Any breach of any of these Rules shall be a breach of an environmental requirement and shall be enforceable under Part VI of the Environmental Management Act.
