Abstract
This Act provides with respect to the Dar-Es-Salaam Water and Sewerage Authority and its admninistration and operations. The Act consists of 54 sections divided into 10 Parts; Preliminary provisions (I); Dar es Salaam Water and Sewerage Authority Act (II); The Board (III); Powers and operations of DAWASA (IV); Regulation of DAWASA and the Operator (V); General provisions (VI); Financial provisions (VII); Transitional provisions (VIII); Offences and penalties (IX); Amendments of the Water Utilization (Control and Regulation) Act, 1974.
DAWASA shall continue to exist pursuant to section 4 as a body corporate (sect. 5). The functions of DAWASA shall include supply of water, develop and maintain waterworks, promote conservation and proper use of water, develop new water projects and other related functions listed in section 6. DAWASA may appoint an Operator and conclude a contract with the Operator or grant a concession to the Operator for the performance of functions and exercise of powers by the Operator vested in DAWASA by this Act (sect. 7). The power to grant a concession is regulated in section 8. DAWASA and the Operator shall in the exercise of their functions be subject to the Energy and Water Utilities Regulatory Authority.
