Abstract
These Regulatios cosisting of 51 articles aim to (i) promote the maximization of value-addition and job creation through the use of local expertise, goods and services, businesses and financing in the mining industry value chain; (ii) develop local capacities in the mining industry value chain through education, skills transfer and expertise development, transfer of technology and know-how and active research; (iii) achieve the minimum local employment level and in-country spend for the provision of the goods and services in the mining industry value chain; (iv) increase the capability and international competitiveness of domestic businesses; (v) create mining and related supportive industries; (vi) achieve and maintain a degree of control by Tanzanians over development initiatives for local stakeholders; (vii) provide for a robust and transparent monitoring and reporting system; (viii) provide for the submission of the local content plan and related sub-plans by contractors, subcontractors, licensees and any other allied entity involved in the mining industry. Article 5 establishes the Local Content Committee for the mining activities responsible for ensuring measurable and continuous growth in local content in all mining activities and in particular (i) overseeing, coordinating, and managing the development of local content; (ii) preparing guidelines for local content plans and reporting; (iii) setting minimum standard requirements for local content in local content plans; (iv) undertaking public education; (v) undertaking local content monitoring and audit.
Part III outlines the requirements for the local content plan, which contractors, subcontractors, licensees, or other entities in the mining industry must submit to the Commission when seeking approval for mining activities. This plan should present a comprehensive long-term strategy aligned with the project's work program and include detailed annual plans. It must specify how the entity will prioritize local goods and services, create employment and training opportunities for qualified Tanzanians, and ensure the use of locally manufactured goods that meet industry standards. Additionally, the plan should include specific sub-plans covering employment, research, technology transfer, legal, and financial services. The Commission will review and approve the plan, with provisions for revisions as needed. Part IV focuses on the Employment and Training Sub-Plan, which contractors, subcontractors, licensees, or other associated entities must also submit to the Commission. This sub-plan should include a forecast of hiring and training needs, a timeline for providing employment opportunities to Tanzanians at each phase of the mining activity, and detailed procedures for accelerating the training of Tanzanians. The Regulations also mandate a research, development, and budgeting program that promotes education, practical attachments, and research and development within the country.
