Decree No. 1149 of the Cabinet of Ministers validating the Regulation on the procedure for setting limits on special use and assessment of the forecast of allowable catch of aquatic biological resources.

This Regulation defines the procedure for setting the limits for special use and determining the forecast of allowable catch of aquatic biological resources within the jurisdiction of Ukraine, in particular in inland fishery water bodies (parts thereof), inland sea waters, territorial sea, Exclusive (marine) Economic Zone and continental shelf, except for the territories and objects of the nature reserve fund. Setting limits and determining the allowable catch forecast are made each year for each species of aquatic biological resources in the respective fishery waterbodies (parts thereof). The limits set are divided into quotas. During commercial fishing, the predetermined allowable catch forecast may be adjusted based on the results of scientific studies on the status of aquatic biological resources. No limits are set, and no forecast of allowable catch is established if the specific use of aquatic biological resources, for which due to the peculiarities of their spatial distribution in a waterbody or due to the technical capabilities of the fishery, the volume of catch cannot be predicted, threatens the state of their stocks. Where the use of aquatic biological resources involves the catch of several related species, the establishment of limits and the prediction of allowable catches may be made with respect to the relevant group of species of such resources. Setting limits and forecast of allowable catch of aquatic biological resources shall be performed on the basis of scientific substantiation of stocks thereof.
