Abstract
This Resolution establishes a comprehensive regulatory framework for the special use of aquatic biological resources. It defines the legal basis for industrial fishing and research catches across national internal and marine waters, including the exclusive economic zone and continental shelf. The Resolution introduces standardized procedures, including the approval of detailed regulations and model contracts governing the right to use aquatic bioresources. It also mandates the implementation of a Unified State Electronic Fisheries Management System, which supports permit issuance, contract management, catch recording, and the marking of fishing gear, thereby ensuring traceability and transparency in fisheries activities.
The regulation sets out mechanisms for establishing annual limits (“quotas”) on the extraction of aquatic species, based on scientific and biological assessments prepared by research institutions and approved by the Ministry of Economy. These limits are allocated as quotas to users through administrative processes and, for industrial fishing, primarily via electronic auctions. The document specifies eligibility requirements for participation, introduces safeguards against market concentration, and excludes certain participants (including certain foreign nationals or entities). It also provides detailed rules for the allocation of quotas, the conclusion of contracts, payment obligations, and the redistribution of unused quotas. Special provisions apply during martial law, temporarily relaxing some reporting and technical requirements.
In addition, the Resolution establishes detailed operational and compliance requirements for fisheries activity. These include mandatory registration and marking of fishing gear with unique identifiers, strict record-keeping through electronic logs, and reporting obligations on catches and fishing operations. It regulates permit issuance, renewal, and termination procedures in electronic form, and outlines conditions under which permits may be denied or revoked. The document further defines procedures for electronic auctions, contract enforcement, and payment schemes for resource use, while also setting environmental and operational constraints to ensure sustainable exploitation of aquatic bioresources. Overall, the regulation aims to modernize fisheries governance, enhance accountability, and ensure the rational and sustainable use of aquatic resources.
