Law № 3928-IX “On grapes, wine and viticulture products”.

This Law regulates legal and organizational relations regarding viticulture, production and sale of grapes, wine and other viticulture products, aromatized wine products, determines the particulars of preparation for registration, use and protection of geographical indications for wines, aromatized wine products, as well as the particulars of control over such geographical indications. Viticulture shall be intended a set of organizational and technological methods of reproduction, cultivation and harvesting of grapes. Certificate shall be intended a document confirming the compliance of a wine/aromatized wine product with the requirements of the specification of a wine/aromatized wine product with a geographical indication. Falsification of viticulture products, wine products shall be intended intentional manufacturing of viticulture products, aromatized wine products in violation of production technology, requirements for their composition or with the unlawful use of an object of intellectual property rights and/or with the unlawful use of product designations of another manufacturer, copying the appearance of a product of another business entity without its permission. This Law does not apply to public relations regarding the production of grapes, viticulture products, and aromatized wine products intended (produced) for personal consumption. It establishes powers of executive bodies in the field of vine-growing and wine-making. Viticulture in Ukraine is carried out within the boundaries of viticulture zones determined by the central executive body, which ensures the formation of state agrarian policy, state policy in the field of agriculture and on issues of food security of the state. Classification of grape varieties is carried out by determining the name of each variety and corresponding varieties known in Ukraine, according to the following criteria: (a) by the color of the berry and/or by the color of the winemaking product, for the production of which the use of the corresponding variety is permitted; (b) by belonging to the species grape (Vitis vinifera) or originating from crossing varieties of this species with other species of the genus grape (Vitis); (c) by belonging to aromatic grape varieties; and (d) by the viticulture zone in which the cultivation of the grape variety is recommended. Vineyard maintenance shall be carried out in compliance with the requirements of the vineyard management project. This Law lists authorized viticulture products, authorized viticulture practices and prohibited viticulture practices. Labelling and presentation on the market of aromatized wine products shall be carried out in compliance with the requirements of this Law. Traceability of viticulture products on the market is ensured by submitting applications, declarations, notifications, and other information provided for by this Law by producers, and maintaining the Viticulture and Winemaking Register. Information from the Viticulture and Winemaking Register, register information is published in the form of open data in compliance with information legislation. This Law contains X Sections divided into 63 Articles. Section I lays down general provisions. Section II establishes powers of executive bodies in the field of vine-growing and wine-making. Section III regards vine-growing. Section IV regards manufacturing of viticulture products. Section V regards aromatized wine products. Section VI regards traceability of viticulture products on the market. Section VII deals with the particulars of preparation for registration of geographical indications of wines and aromatized viticulture products. Section VIII regards certification of wines and aromatized wines with geographical indication. Section IX applies control of the compliance of wines and aromatized wines with specific geographical indication. Section X deals with circulation of grapes, viticulture products, aromatized wines, packaging, labelling and quality control thereof.
