Abstract
The Provisional Regulation is composed of 11 Sections. Provisional Regulation regards protection, management and creation of aquatic living resources, conducting fisheries and fishing. Fisheries is a branch of the national economy which purpose is research, protection, management creation on scientific basis of aquatic living biodiversity for the purpose of conservation of various types of fish products, fodder, technical and medical products. Fisheries must be carried out in the surface water, territorial waters, EEZ of the Ukraine, continental shelf of the Ukraine and also in the open sea and foreign EEZ. The term living aquatic resources refers to: 1) freshwater fishes, marine fishes, anadromous fishes; 2) cyclostomata; 3) marine mammals, including cephalopoda molluscs; 4) crustacean; 5) algae and aquatic plants. The main principles of carrying out fisheries and fishing include: 1) non violation of habitats of fish stocks; 2) protection of fish stocks against poaching; 3) observance of the established quotas, fishing seasons and regulations of management of living aquatic resources; 4) ensuring scientifically substantiated rational management of living aquatic biodiversity.
