Abstract
These Requirements apply to relationships related to: (a) production and circulation of live bivalve molluscs, live echinoderms, live gastropods and live marine gastropods, except for live marine gastropods that are not filter feeders and live echinoderms that are not filter feeders; (b) classification of territories for the production of live bivalve molluscs and other control species and territories for the restocking of live bivalve molluscs and other control species; (c) conducting a sanitary inspection for the purposes of classifying production areas and repopulation areas; (d) monitoring of production areas and resettlement areas; and (e) maintaining a List of classified production areas and repopulation areas. For the purpose of organizing state control, the competent authority shall establish the location and boundaries of production areas and repopulation areas, and shall also classify the relevant areas. For the purpose of classifying production areas and restocking areas, the competent authority shall ensure that a sanitary inspection is carried out, which should include: (a) determination (establishment) of a list of pollution sources (human and animal origin) that can potentially pollute the production area/repopulation area; (b) research (study) of the amount of organic pollutants released at different times of the year, in accordance with seasonal fluctuations in human and animal populations in the catchment area (if any), precipitation rates, wastewater treatment, etc.; (c) determination of the characteristics of pollutant circulation based on modern models, bathymetry and tidal cycle in the production area/repopulation area. A sanitary inspection must be carried out on all classified production areas/repopulation areas. For the purposes of organizing and conducting sanitary inspections, the competent authority shall cooperate with other state authorities, market operators, relevant institutions, enterprises and/or organizations. The competent authority has the right to receive free of charge from state authorities and local self-government bodies information, documents and materials necessary for organizing and conducting a sanitary inspection. Data obtained during the sanitary inspection shall be subject to evaluation, which shall include a qualitative assessment and/or a semi-quantitative assessment and/or a quantitative assessment. Every six years, the competent authority shall ensure that a full review of the results of the sanitary survey in terms of sources of pollution and the sampling plan is carried out. The competent authority shall ensure that the coastline is surveyed for the following purposes: (a) verification (confirmation) of information regarding the location, boundaries and scale of the production area/repopulation area; (b) verification (confirmation) of information regarding potential sources of pollution; and (c) identification (establishment) of additional potential sources of pollution.
