Abstract
This Decree No. 05/2025/ND-CP amends and supplements Vietnam’s Decree No. 08/2022/ND-CP, providing detailed guidance on implementing the Law on Environmental Protection. It introduces new definitions related to wastewater, emissions, and environmental impact assessments (EIAs), and decentralizes the authority to appraise EIAs and issue environmental licenses to provincial People's Committees for certain types of projects. The decree also clarifies procedures for consultation, licensing, and trial operation of waste treatment facilities, and outlines specific conditions under which projects must revise their EIAs or apply for new licenses due to changes in scale, technology, or environmental impact.
Additionally, the decree strengthens regulations on hazardous waste management, environmental monitoring, and extended producer responsibility (EPR). It mandates financial contributions from producers and importers to support recycling and waste treatment, with clear formulas and reporting requirements. The decree also introduces incentives such as tax exemptions for environmentally friendly practices and outlines responsibilities for various government levels and agencies. It emphasizes transparency, public participation, and the use of digital systems for environmental data management.
