Abstract
This Law, consisting of 76 articles divided into seven Chapters and completed by four Appendices, provides for business investment activities in Vietnam and outward business investment activities. The banned business lines shall include: business in specimens of wild flora and fauna specified in Appendix 1 of Convention on International Trade in Endangered Species of Wild Fauna and Flora; specimens of rare and/or endangered species of wild fauna and flora in Group I of Appendix III; etc. Conditional business lines are the business lines in which the business investment must satisfy certain conditions for reasons of national defense and security, social order and security, social ethics, or public health. A List of conditional business lines is provided in Appendix IV, including: petro and oil trading; gas trading; etc.
The Law establishes the sectors and requirements benefiting from investments. Sectors and trades eligible for investment incentives are: hi-tech activities, hi-tech supporting industry products, research, manufacturing and development of products formed from science and technology results in accordance with regulations of law on science and technology; manufacturing of new materials, new energy, clean energy, renewable energy; manufacturing of products with an added value of 30% or more; energy-saving products; manufacturing of key electronics, mechanical products, agricultural machinery, automobiles, automobile parts; shipbuilding; breeding, growing and processing of agriculture products, forestry products, aquaculture products; afforestation and forest protection; salt production; fishing and fishing logistics services; production of plant varieties, animal breeds and biotechnology products; collection, treatment, recycling or re-use of waste; etc.
