Abstract
The Statute Law (Miscellaneous Provisions) Act No. 2 of 2021 in the Republic of Vanuatu is a comprehensive legislative document that outlines amendments to several existing laws. The Act covers a wide range of areas, including amendments to Water Resources Management Act [CAP 281].The Act provides amendments on Section 26 of the above Act and provides for substitution of "Minister" instead of "Director" and substitution of “Minister may in writing, on the advice of the Director,” instead of “Director may in writing”.
The Act amends the Centralization Act [CAP 230] as follow: reference to "Chairman" is substituted by "President" and "Vice President" is replaced “Deputy Chairmen”, “Deputy Chairman” or “Vice Chairman”.
Amendments on Geothermal Act No. 40 of 2019 include nomination of a representative of the Malvatumauri Council of Chiefs by the President of the Malvatumauri Council of Chiefs in paragraph 5 and 28.
Government Contracts and Tenders Act (CAP 245) is amended slightly on Subsection 11 (4) be referring to deleting “Public Service Commission”, and substituting “Government Remuneration Tribunal”.
Quarantine Act (Cap 1) amendments provides that "communicable disease” has the same meaning as “notifiable disease” defined in the Public Health Act [CAP 234].
The amendments to the Supply of Electricity (Districts) Act (CAP 96) involve replacing references to "Public Works" with "Energy," updating definitions and procedures related to billing and subscriber accounts, and substituting specific departmental names and titles throughout the Act.
The amendments to the Industrial Development Act No. 19 of 2014 involve reducing the duration of permits issued under subsection 4(4) to one year and revising the criteria for indigenous brands in paragraph 13(3)(e) to include products made, grown, produced, or designed in Vanuatu.
The amendments with regard to Penal Code (CAP 135) include not using threatening language by a person; and not making a false written representation on any public platform respectively in Sections 114 A, 120 and 121.
