Abstract
These Regulations implement and give effect to provisions of the Marine Living Resources Act with respect to: management and conservation of fish resources and other marine living resources including whales, dolphins and turtles; mariculture; landing, transport and marketing of fish and fish products; fishing harbours; enforcement; and administrative matters including appeals in terms of section 80 of the Act, procedures of the Consultative Advisory Forum for Marine Living Resources and the content of the register referred to in section 12(1) of the Act.
As for marine living resources management and conservation, the Regulations: prescribe rules relative to licences, close seasons and closed areas, use of gear, trawl fishing, purse-seine fishing and other types of traditional and commercial net and line fishing, recreational fishing; and place general and specific restrictions on the fishing for species including general size and mass limits, disposal of fish and aquatic plants, dumping, gear restrictions, bag limits, size, etc. Regulated species include sharks, oyster, lobster and whales, aquatic plants dolphins and turtles.
One Chapter applies to mariculture undertaken for commercial, experimental or research purposes. Its provisions concern the application for permits, general permit conditions, minimization of environmental impact caused by mariculture and environmental impact assessment, permission to release fish in South African waters, the permission to culture or use any genetically modified organism, use of drugs and control of diseases.
Other provisions of these Regulations concern, among other things, the control on the landing and delivery of fish and fish products, compliance control, disposal of fishing gear at sea, marking of fishing vessels and offences.
