Abstract
This Federal Act concerns search for and extraction of free, federal and private-owned mineral raw materials; their processing; geological structures used for storing liquid or gaseous hydrocarbons; geothermal energy and thermal use of water; examining the subsurface for storing materials; introduction of substances into the geological structures; the use of mine workings.
The Act gives definition of several relevant terms, including geological structure, mineral raw material, search, extraction and mining authorization, loose rock, solid rock, mining waste.
The text consists of 224 articles divided into 16 parts: part 1 concerns general provisions and clarification of relevant terms; part 2 provides for searching and working report on mineral raw materials; part 3 concerns mining authorization, mining permits, exploration and exploitation of free mineral raw materials; part 4 concerns exploration and extraction of federally owned mineral raw materials and storage of hydrocarbons in geological structures; part 5 concerns extraction of private owned mineral raw materials above ground; part 6 provides for storage of hydrocarbons in non-hydrocarbon-bearing geological structures; part 7 establishes rules, conditions, powers and duties to exercise mining permits and indicates the authorities responsible for its implementation; part 8 concerns mining and land property and granting the use of private surface water; part 9 establishes competent authorities and their duties and powers; part 10 concerns costs; part 11 provides for safety of mines and protection against gas leak; part 12 establishes the Mining Advisory Committee; part 13 provides for payment of mining fees; part 14 empowers the Federal Minister for Economics to award a mining authorized person; part 15 concerns penalties and criminal provisions; section 16 contains transitional and final provisions.
