Abstract
This Law establishes the legal basis for the organization of hunting and hunting facilities, the implementation of their activities, as well as the protection, increase and use of hunting facilities in Azerbaijan. The purpose of this Law is to effectively organize hunting activities in Azerbaijan by regulating, protecting, and increasing the number of permanent, temporary and migratory wild animal species living under free and semi-free conditions, as well as by ensuring their breeding, release into hunting grounds and the preservation of their habitats.
This Law classifies wild animals living free and semi-free in hunting areas, their skins, skin coverings, horns, bones, products of vital activity, as well as their habitats as objects of hunting activity. Article 6 addresses hunting and game management to be based on the following principles: (i) biodiversity conservation and ecosystem preservation; (ii) effective use of hunting facilities for the development of science and culture; (iii) state control over the protection, breeding and use of wild animals in hunting facilities; (iv) protection of the habitats, migration routes, wintering grounds, breeding and reproduction conditions of wild animals in hunting facilities; (v) use of wild animals in accordance with biological ethics; (vi) charging and limiting the use of wild animals and hunting in hunting facilities; and (vii) identification and regulation of dangerous wild animals in order to prevent damage to public health, nature and the economy in a timely manner.
This Law lays down provisions on the designation of wild animal species as hunting objects and determination of hunting limits; powers of the state in the field of organization and management of hunting and hunting facilities; control over hunting activities and the protection and use of hunting facilities; participation of hunters' associations in the organization and management of hunting and hunting facilities; cadastre and monitoring of hunting facilities; state audit of the number of wild animals included in the hunting object and hunting rules; allocation of hunting areas by the relevant executive authority to carry out hunting activities; hunting fees; procedures and requirements for hunting certificate; types of hunting gears and rules for their use; hunting season and hunting days; rights and responsibilities of hunters; hunting prohibitions and restrictions; categories of hunting facilities; schemes for the development and placement of hunting farms; stimulation and financing of hunting farms; and compliance with the relevant international treaties and agreements.
