Abstract
This Law regulates the protection and management of air quality, defines goals and responsibilities, air quality parameters, air quality planning, measures to improve air quality, measures to protect the ozone layer, measures to mitigate and adapt to climate change , emission measurement tasks, information and reporting, financing of air quality protection and improvement, information system, administrative supervision and penal provisions. However Cantons, depending on their specificities, can pass their own laws regulating the issue of air quality protection. The provisions of this Law do not apply to pollution caused by radioactive substances, industrial accidents, natural disasters and noise. The federal and cantonal ministries responsible for the environment, spatial planning, construction, traffic, energy, mining, industry, agriculture, economy and health are responsible for the prevention, protection and improvement of air quality and mitigation and adaptation to climate change, each within its jurisdiction.
The text is structured into eleven main thematic Chapters and a total of 83 articles. Titles of these Chapters are as follows: I. General provisions; II. Air quality; III. Planning; IV. Measures for the improvement of air quality; V. Measurement activities; VI. Informing, notifying and reporting; VII. Financing of air quality protection and improvement; VIII. Information system; IX. Supervision; X. Penal provision; XI. Transitional and final provisions.
Primary objectives determined in this Law are: a) avoiding, preventing or reducing harmful consequences for human health, quality of life and the environment as a whole; b) establishing, maintaining and improving a unique air quality management system in the territory of the Federation of Bosnia and Herzegovina; c) preservation and improvement of air quality through the determination and implementation of measures in the field of air protection in order to prevent or reduce harmful consequences for human health and/or the environment; d) avoidance, prevention and reduction of pollution affecting the damage to the ozone layer and climate change; e) monitoring, obtaining and evaluating appropriate air quality data based on measurements and standardized methods; f) ensuring the availability of air quality data; g) fulfilling obligations in accordance with confirmed international agreements in the field of air quality protection and improvement, ozone envelope, climate change and ensuring the availability of that data to the public.
