Law No. 9.866 reformulating the State Fund for Water Resources of Espírito Santo (FUNDÁGUA).

This Law, consisting of 25 articles divided into seven Chapters, reformulates the State Fund for Water Resources of Espírito Santo (FUNDÁGUA) aimed to articulate the State Policy of Water Resources with actions, programmes and projects to increase the forestry cover of the State. FUNDÁGUA now represents the State Fund for Water and Forestry Resources of Espírito Santo aimed at collecting and applying resources, as one of the instruments of the State Policy for Water Resources and at enabling the maintenance and recovery of the State's forestry cover, to support the implementation of these objectives, linked to the State Secretariat for the Environment and Water Resources (SEAMA). FUNDÁGUA will be administered by SEAMA, aiming at regulating the following matters: elaboration of the Fund's Application Plan; arrangements for the application of the resources of the Fund; controls for the budgetary execution of the Fund; controls on the assets of the Fund; controls on agreements, contracts, adjustments, loans or financing measures related to the Fund; annual accounts; form of liquidation and the allocation to be given to the equity of the Fund in the event of its liquidation or extinction.
